부양의무를 조건으로 부모 재산을 상속받았지만 그 후 이행하지 않거나 범죄를 저질렀을 때 상속재산을 해제할 수 있는 <불효자방지법>을 서영교 위원장이 대표발의했다.

 

현행 법제도는 부모가 재산을 증여한 이후 자녀가 부양의무를 이행하지 않아 생계의 어려움을 겪고 있더라도 증여한 재산을 돌려받을 수 없게 되어 있는 것은 물론 학대나 부당한 대우를 받게 되더라도 이를 시정하기 어려운 실정이었다.

 

이에 따라 서영교 위원장이 대표발의 한 <불효자방지법>, 「민법」 개정안은 제556조에서 증여자에 대하여 부양의무를 이행하지 않거나 증여자에 대하여 학대 또는 신체적 고통이나 폭언 등의 정신적 고통을 가한 경우, 부양의무이행 명령이 가능하도록 할 수 있을 뿐만 아니라 증여 해제도 가능하도록 한다.

 

서영교 위원장은 “자식에게 아낌없이 정성을 쏟아 키운 후, 부모를 부양한다는 조건으로 자녀들에게 재산을 상속했지만 의무를 이행하지 않고 외면해 생계가 매우 곤란한 어르신들이 사회 곳곳에서 힘들어하고 있다”고 발의 배경을 설명하며, “<불효자방지법>을 통해서 재산 상속에 대한 근본적 의미를 되새길 필요가 있다”고 밝혔다.

 

한편, 해외사례를 살펴보면 독일·프랑스·오스트리아 등 유럽국가들은 「민법」에 증여를 철회하는 방안을 명시하고 있다. 독일의 경우, 「민법」530조에서 “증여자 또는 그의 근친에 대해 중대한 배은행위로 비난을 받을 때 철회가능”하며, 프랑스는 953조에서 “생명에 위해를 한 경우, 학대 모욕 범죄를 한 경우, 부양을 거절하는 경우 철회가능”하다. 또한, 오스트리아는 민법 948조에서 “신체·명예·자유 또는 재산에 대한 가해 등 중대한 망은행위에 대해 증여 철회가능”을 적시하고 있다.
